Terms of Service
Last updated: October 11, 2026
These Terms are written in English and translated for your convenience. The English text governs, except where the law of your country gives you the right to rely on the translation (for example, consumers in Québec may rely on the French version).
Welcome to MyCareCompanion. MyCareCompanion is a registered DBA of JB2S Enterprises, LLC, a Texas limited liability company in the United States. These Terms of Service ("Terms") are a legally binding agreement between you ("you") and JB2S Enterprises, LLC d/b/a MyCareCompanion ("we," "us" or "our") governing your use of our care management website, apps and related services (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
IMPORTANT: These Terms contain limitations of liability, a disclaimer of warranties and, for users in the United States, an arbitration clause and class-action waiver. Section 13 explains which of these do not apply to consumers in Canada, the United Kingdom, the European Economic Area, Australia and New Zealand. Nothing in these Terms takes away rights you have under the consumer-protection law of your country that cannot be waived by contract.
1. Eligibility and your account
1.1 Eligibility
You must be at least 18 years old (or the age of majority where you live, if higher) and able to enter into a binding contract. The Service is for adults who care for children; children do not have accounts.
The Service is offered to residents of the countries listed on the registration form. It is not currently offered to residents of the province of Québec. If you move somewhere the Service is not offered, you may keep using your account, but we may be unable to sell you new plans or packs there.
1.2 Account registration
You agree to provide accurate information, keep it current, keep your login credentials confidential, accept responsibility for activity under your account, and tell us immediately about any unauthorized use.
1.3 Authority over children's information
If you enter information about a child, you confirm that you are the child's parent or legal guardian, or a caregiver authorized by one, and that you may lawfully enter and share that information with the family members you invite. You are responsible for who you invite and for removing them when their role ends.
2. The Service
MyCareCompanion is a care-organization and journaling tool. It helps parents, caregivers and the providers they invite record daily activity, health events, sleep, meals, behaviour and medications; set reminders; see patterns and AI-assisted insights in their own records; transcribe healthcare visits; import paper journals and files; chat as a family; and produce reports to share with a care team. Features vary by plan and by country; some features may not be available where you live.
3. Acceptable use
3.1 Permitted use
Use the Service only to manage care for children and family members, lawfully and in accordance with these Terms.
3.2 Prohibited conduct
You agree not to: violate any law, including child-welfare, privacy or data-protection law; enter false or fabricated information about a child or use the Service in any way that could harm, exploit or endanger a child; misrepresent your identity, relationship to a child or authority to access information; harass, threaten or abuse any person; access accounts, data or systems you are not authorized to access or interfere with the Service; infringe intellectual property; upload malicious code; use the Service for unauthorized commercial purposes, scraping or competing services; collect other users' information without consent or share login credentials; or knowingly enter false medical information.
3.3 Enforcement
We may investigate and act on violations, including removing content, suspending or terminating accounts, reporting to law enforcement and pursuing legal remedies.
3.4 Reporting objectionable content or abusive users
To report abusive, harassing or otherwise objectionable content — including a message from another family member or a community post — tap the report icon next to it in the app, or email support@mycarecompanion.net. We acknowledge reports within 24 hours and act within 48 hours, which may include removing content, restricting or suspending the user, or terminating their account. Family owners can remove members at any time from Settings → Members, which immediately revokes that member's access.
4. Plans, payment and taxes
4.1 Plans and prices
Some features require a paid plan. Current plans and prices are shown on our website and in the app in the currency of your country. Prices shown to consumers in the European Economic Area, the United Kingdom, Australia and New Zealand include applicable sales tax; prices shown in the United States and Canada exclude sales tax, which is added at checkout where we are required to collect it. We may change prices with at least 30 days' notice before your next renewal; if you do not agree, you may cancel before the change takes effect.
4.2 Free trial
New families receive a free trial. At the end of the trial you are charged for the plan you selected unless you cancel first; we remind you by email before the first charge.
4.3 Billing and currency
By subscribing you authorize us, through our payment processor Stripe, to charge your payment method on a recurring basis (monthly or yearly) until you cancel. The currency of your account is fixed at your first purchase based on your country. You are responsible for keeping a valid payment method on file.
4.4 Cancellation and refunds
Cancellation. You may cancel at any time in Settings. You keep access until the end of the period you have paid for and are not charged again; after that the app is read-only and nothing is deleted. You can undo a cancellation before the period ends and re-subscribe later.
Refunds. Beyond the rights described in section 13 for your country, subscription fees are non-refundable once a billing period has started, except where we have failed to provide the Service as described. Prepaid credit packs (transcription hours, journal pages) are non-refundable once any part of the pack has been used.
Right of withdrawal (EEA and UK consumers). You have 14 days from purchase to withdraw from a subscription or pack and receive a full refund, unless you asked us to start providing the Service immediately and have used it, in which case we may deduct a proportionate amount for the Service provided. To withdraw, email support@mycarecompanion.net.
5. Account deletion and your data
You may delete your account at any time (Settings → Delete My Account, or www.mycarecompanion.net/delete-account). Deletion starts a 30-day grace period during which the data is kept but inaccessible: for 14 days you can restore the account yourself from the link in our email; from day 15 to 30 we can restore it on request after verifying your identity; on day 30 the account and all family data are permanently removed from our production systems, and from encrypted cold backups within a further 90 days. At deletion we send you a link to export a copy of your family's data (CSV, Excel or SQLite). Exports are unencrypted files containing health information about your child; once downloaded they are in your care.
If you created the family, deleting your account deletes the family and all its data after the grace period, and every member you invited loses access immediately; contact support first if you would rather transfer ownership. If you are a member of a family someone else created, deleting your account removes your access but the family's records remain with the family owner.
6. Intellectual property and your content
The Service, including its software, design, text, graphics, logos and trademarks, belongs to us or our licensors and is protected by United States and international law. You may not copy, modify, distribute, sell or lease any part of it without our written consent. You keep ownership of the content you enter ("Your Content"). You grant us a limited, non-exclusive licence to store and process Your Content solely to provide and improve the Service for you; we use it for nothing else without your consent.
7. Translations and AI-generated text
The Service is written in English and translated into other languages with the help of artificial intelligence. We correct translation errors that we find or that you report to us, and you can switch the app to English at any time in Settings. Translations are provided for convenience. A translation may be imperfect; if a medication, dose or alert reads oddly, check the English text and ask your care team. The English Terms govern, except where the law of your country gives you the right to rely on the translation.
Insights, summaries and suggested log entries that are generated by AI are labelled as such. They are drawn from your own records, can be wrong, and are information for you and your child's care team to weigh — not advice or conclusions. Nothing is added to your child's record from an AI suggestion until you confirm it.
8. Medical disclaimer
THE SERVICE IS NOT A MEDICAL DEVICE AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS OR TREATMENT.
- The Service helps you organize and track information. It does not diagnose, treat, cure or prevent any condition and does not provide medical advice.
- Medication reference information comes from public drug directories (for example the US FDA or Health Canada) and may not match the product sold in your country; always follow the label and your prescriber.
- Insights, patterns and alerts are for information only and should not be relied upon for medical decisions. Always seek the advice of a qualified health professional.
- Never disregard professional medical advice or delay seeking it because of something in the Service.
- In a medical emergency, In an emergency call 911.
9. Disclaimer of warranties
TO THE EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not warrant that the Service will meet your requirements, be uninterrupted or error-free, or that its results will be accurate. Consumers in some countries have statutory guarantees that cannot be excluded; section 13 describes them.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR OFFICERS, EMPLOYEES, AGENTS AND LICENSORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, USE OR DATA, ARISING OUT OF YOUR USE OF (OR INABILITY TO USE) THE SERVICE, ANY THIRD-PARTY CONDUCT OR CONTENT, OR UNAUTHORIZED ACCESS TO YOUR CONTENT. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS. These limits apply to every theory of liability, whether or not we were told the damage was possible. Nothing in this section limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under the law that applies to you.
11. Indemnification
To the extent permitted by law, you agree to defend and indemnify us and our officers, employees, agents and licensors against claims, damages and reasonable costs (including legal fees) arising from your use of the Service, your violation of these Terms or of another person's rights, or Your Content. This section does not apply to consumers where the law of their country prohibits such clauses.
12. Dispute resolution, governing law and arbitration (United States)
12.1 Talk to us first
Before starting any formal proceeding, contact us at legal@mycarecompanion.net so we can try to resolve the matter informally within 30 days.
12.2 Governing law
These Terms are governed by the laws of the State of Texas and the United States, without regard to conflict-of-law rules, except that if you are a consumer living outside the United States you also benefit from the mandatory consumer-protection law of your country, which prevails where it conflicts with these Terms.
12.3 Arbitration and class-action waiver for users in the United States
If you live in the United States, any dispute that is not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in Texas or by video, and you and we each waive the right to bring claims as a plaintiff or class member in any class or representative proceeding. Either party may instead bring an individual claim in small-claims court, and either may seek injunctive relief in court to protect intellectual property. Judgment on an arbitration award may be entered in any court of competent jurisdiction.
12.4 Courts for users outside the United States
If you live outside the United States, section 12.3 does not apply to you. You may bring a claim in the courts of the country (and province or state) where you live, and we may bring a claim against you there. Section 13 adds the rules for your country.
13. Your country's consumer rights
13.1 Canada
Consumers in Canada have rights under provincial consumer protection law (for example Ontario's Consumer Protection Act and Québec's Consumer Protection Act) that cannot be waived. The arbitration clause and class-action waiver in section 12.3 do not apply to Canadian consumers. Québec: these Terms and the Privacy Policy are available in French at /fr/terms and /fr/privacy; where the Charter of the French language or the Consumer Protection Act gives you the right to rely on the French version, that right is not affected by section 7. You may cancel a subscription at any time, and the refund rules of your province apply where they are more favourable than section 4.4.
13.2 United Kingdom
If you are a consumer in the UK, the Consumer Rights Act 2015 applies: digital content must be as described, fit for purpose and of satisfactory quality, and you have remedies (repair, replacement, price reduction or refund) that these Terms do not limit. You have a 14-day right to cancel a distance contract (section 4.4). Nothing limits our liability for death or personal injury caused by negligence or for fraud. You may use the courts of England and Wales, Scotland or Northern Ireland according to where you live.
13.3 European Economic Area
If you are a consumer in the EEA, Directive 2019/770 (digital content) and your national consumer law apply: the Service must conform to the contract, and you have remedies for non-conformity that these Terms do not limit. You have a 14-day right of withdrawal (section 4.4). Our contract with you is formed in English or, where available, your language; the information required under the Consumer Rights Directive is in sections 2, 4 and 13. The European Commission's online dispute resolution platform is available at ec.europa.eu/odr; we are not obliged and do not undertake to participate in alternative dispute resolution unless the law of your country requires it. You may bring proceedings in the courts of your member state.
13.4 Australia
Our Service comes with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to cancel the Service and receive a refund for the unused portion or compensation for its reduced value; for other failures you are entitled to have the problem fixed within a reasonable time or, if not, to a refund. Nothing in these Terms excludes, restricts or modifies those guarantees. Where the law permits, our liability for a failure of a guarantee is limited to resupplying the Service or refunding the amount you paid for the period affected.
13.5 New Zealand
If you acquire the Service for personal use, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 apply and nothing in these Terms limits your rights under them. If you acquire the Service for business purposes, you agree that the Consumer Guarantees Act does not apply.
13.6 Other countries
If you are a consumer in any other country where we offer the Service, nothing in these Terms limits rights your local consumer-protection law gives you that cannot be waived by agreement. Prices are shown in US dollars unless a local currency is offered; your card issuer may add a conversion fee. Where your country charges a tax on digital services that we are not required to collect, any such tax is your responsibility. The English version of these Terms governs; translations are provided for convenience.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, with notice where the law requires it and, except in cases of serious or repeated breach, an opportunity to export your data first. On termination your right to use the Service ends; provisions that by their nature should survive (intellectual property, disclaimers, limitations of liability, dispute resolution) survive.
15. Changes to these Terms
We may modify these Terms. We will post the updated Terms with a new "Last updated" date and, for material changes, notify you by email or in the app at least 30 days before they take effect, unless a change is needed sooner for legal or security reasons. If you do not agree, cancel and stop using the Service before the change takes effect; continued use after that date means you accept the change.
16. General
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If a provision is held unenforceable it is removed and the rest remains in force. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor who takes over the Service, and will notify you. We are not liable for failures caused by events beyond our reasonable control. Notices to you may be given by email to the address on your account.
